Fair Labor Standards (FLSA) Setup

Fair Labor Standards Act (FLSA) determines how many hours fire and police employees can work within a certain amount of days before they need to be compensated. Hero Schedule allows you to track and alert you if there is a change made that wouldn’t fit these standards, or calculate the amount of overtime they have earned.


Section 7(k) of the FLSA provides that employees engaged in fire protection or law enforcement may be paid overtime on a “work period” basis. A “work period” may be from 7 consecutive days to 28 consecutive days in length. For work periods of at least 7 but less than 28 days, overtime pay is required when the number of hours worked exceeds the number of hours that bears the same relationship to 212 (fire) or 171 (police) as the number of days in the work period bears to 28. For example, fire protection personnel are due overtime under such a plan after 106 hours worked during a 14-day work period, while law enforcement personnel must receive overtime after 86 hours worked during a 14-day work period.

Kelly Days

Kelly Days (typically for fire departments) can be set up in this setup area. There are two great ways to set them up in Hero Schedule. Ask us for assistance when setting these up.


Basic FLSA Setup

  1. Maximum Hours Rules set the rules by each Department.
  2. Go to Menu > Organization Setup > Fair Labor Standards
  3. Click on the Maximum Hours Rules tab
  4. Select the pencil icon to next to All
    1. Days in Period (set to the time span for the rule. Typically 14 days, 28 days, etc.)
    2. Maximum Hours per Period (set to the FLSA rule that you are working with)
    3. First Day of Any Period (set to the beginning of the current FLSA period you are in. The system will set this forward and backwards from that date)
    4. Click Save

Basic setup

This method allows you to calculate the number of hours worked over a certain period of time. It takes into account any time off and overtime worked during the period.

  1. Go to Menu > Organization Setup > Fair Labor Standards
  2. Click on the Overtime Policies tab
  3. Click Add Overtime Policy
  4. Fill out:
    1. Policy Name (Patrol)
    2. Date Period (Manual Entry)
    3. Days in Period: 14 days
    4. First Day of Any Period: (select the first day in your current work cycle)
    5. Policy Applies to: (select Schedule View Grouping, then select the groups that belong in this rule)
    6. Exclude Activities: (optional)
    7. Exclude Overtime Categories: (optional)
    8. Rules
      1. Hours worked: 171 hours
      2. Multiplier: x1
      3. Account: FLSA Overtime

    9. Click Save
